AA Stand By You Terms & Conditions

The following terms, conditions and exclusions shall govern the provision of the Stand By You service ("Service") in terms of ("The Agreement") between the AA and ("Subscribing AA Members") and these terms and conditions shall be read with and deemed to be incorporated in ("The Service Level Agreement") the AA has with itís service provider, ADT Security, which shall apply hereto mutatis mutandis:

  1. Only valid AA Members can subscribe to the Service. Valid AA Members are Members of the Automobile Association of South Africa whose AA Membership subscription fees are paid up to date. The Service is included in AA Advantage Plus Membership at no additional cost to the AA Member.
  2. The Service cannot be subcribed to in isolation of subscribing to an AA Membership product.
  3. The sole purpose of the Service is to minimise the risk of injury to and/or attack of Subscribing AA Members and other occupants of such Member's vehicle.
  4. The Service is only available in urban areas where ADT Security have an infrastructure presence. Furthermore, the Service is only available in selected areas of Johannesburg, Tshwane, Midrand, Cape Town, Paarl, George, Hermanus, Port Elizabeth, Durban, Bloemfontein, East London, Kimberley, Pietermaritzburg, Witbank, Rustenburg, Brits, Hartbeestpoort, Nelspruit, Polokwane, Welkom and the Vaal Triangle.
  5. The Service is subject to availability and certain areas are excluded from the Service. Therefore, should the Service be requested in an area not covered by the Service, the AA reserves the right to refuse the Service to the Subscribing AA Member.
  6. The Service can only be requested if the breakdown of the vehicle occurred at the roadside and not at any other location.
  7. In order to obtain the Service, the Subscribing AA Member must request the Service from the AA Emergency Call Centre at the same time of requesting roadside assistance. The AA will not automatically dispatch the Service to a Subscribing AA Member. Furthermore, it is at the AA's discretion to dispatch the Service to a Subscribing AA Member based on the description provided to the AA by the Subscribing AA Member of the prevailing security circumstances at the incident scene.
  8. Subscribing AA Members can only activate the Service by contacting the AA Emergency Call Centre. The Subscribing AA Member must provide sufficient information to enable the AA to locate where he/she is stranded.
  9. The Service can only be used in conjunction with roadside assistance rendered by the AA. A Subscribing AA Member will not be entitled to use the Service in isolation.
  10. Possible delays to respond to a Subscribing AA Members' call-out, which are beyond the AA and ADT Security's control, may be experienced in certain areas due to traffic patterns, weather conditions, peak service demands experienced by ADT Security, limited available ADT Security fleet capacity and other relevant factors.
  11. On arrival at the incident scene, the ADT Security response officer will wait with the Subscribing AA Member as long as the ADT Security response officer deems necessary and provided that no immediately threatening, emergency alarm situation arises in the vicinity of the attending ADT Security response officer which may require the withdrawal of the ADT Security response officer from the incident scene prior to the arrival of the AA. The AA will endeavor to arrive at the incident scene prior to the departure of the ADT Security response officer from the incident scene.
  12. To qualify for the Service the Subscribing AA Member must be present at the incident scene and the Member is required to show his/her valid AA Membership card to the person providing the assistance, and may also be asked to produce personal identification.
  13. In the event that a Subscribing AA Member exceeds the number of free roadside assistance call-outs applicable to the Subscribing AA Members' Membership option, the Subscribing AA Member may continue to make use of the Service provided that the Subscribing AA Member pays the applicable fee imposed on AA Members that exceed the number of free roadside assistance call-outs applicable to the relevant Membership option.
  14. Under no circumstances will ADT Security or the AA assist the Subscribing AA Member in providing an escort service, transportation or home security service. Furthermore, the attending ADT Security response officer will not be permitted to provide the Subscribing AA Member any form of roadside assistance.
  15. The subscription period to the Service is a minimum period of one (1) year.
  16. Twenty one (21) days written notice must be given to the AA to cancel the Service subscription.
  17. Subscription fees to the Service are non-refundable.
  18. AA Membership is not transferable and the Subscribing AA Member shall not be entitled to cede, transfer or assign any of his rights to the Service in terms of these standard conditions. This Service will only be provided to Subscribing AA Members, as AA Membership provides personal cover. The Subscribing AA Member may not use his/her personal Membership to obtain assistance for a spouse, dependant, friend, family Member or business associate.
  19. The AA reserves the right to amend these standard conditions at any time without prior notification to Subscribing AA Members, at which time such amendment shall become effective and binding on the Subscribing AA Member.
  20. ADT Security as an independent contractor will render the Service provided in terms of This Agreement to the Subscribing AA Member on behalf of the AA.
  21. It is recorded and agreed that the services of ADT Security and the AA cannot guarantee safety or prevention of loss, liability, injury and damage of whatsoever nature and however arising. Accordingly, while ADT Security and the AA shall exercise care in rendering the Service, nothing herein contained shall be construed or interpreted in any manner as providing the Subscribing AA Member or any third party with any guarantee or assurance of safety or prevention against loss, liability, injury or damage of whatsoever nature and howsoever arising.
  22. The AA and ADT Security shall not be liable to the Subscribing AA Member for consequential or direct or indirect damages, nor for any damages incurred by a Subscribing AA Member in any way associated with the Service, for any loss or damage of whatsoever nature sustained by the Subscribing AA Member and/or his/her vehicle's occupants as a result of the failure, for whatsoever reason, by ADT Security and/or the AA to render the Service in terms of This Agreement timeously or at all or as a result of the manner in which such Service may be rendered by ADT Security and the AA, or from any other cause whatsoever, including negligence, omission and willful default.
  23. The AA makes no warranties of any nature whatsoever nor accepts any responsibility or liability of any nature whatsoever, for any claims, loss or damage of any nature whatsoever arising out of or in connection with the supply of the Service in any way.
  24. In the event that the AA does not receive payment for the Service, the AA reserves its rights to immediately cancel the Memberís subscription to the Service and will then be entitled to refuse to provide the Service.
  25. The AA reserves the right to cancel a Subscribing AA Membersí Membership, if it becomes apparent that the Subscribing AA Member is abusing the Service, if the Subscribing AA Member is using the Service benefits fraudulently, if the Subscribing AA Membersí record of Service claims warrants such action or in circumstances deemed necessary by the AA Board of Directors.
  26. The provision of the Service is subject to the AA's standard emergency rescue service and AA Membership terms and conditions.
