Not My Fault

Question:

I had an accident in September 2009. My car was written off. The accident was not my fault as the other guy skipped a stop street and I went into him. My issue is, I had a huge excess on my insurance which I had to pay, and should this excess be reimbursed to me knowing that the accident was not my fault?

Answer:

Insurance companies have three (3) years within which to recover monies from third partys, if they want to extend this three (3) year period, they would have to issue summons. There is no guarantee that your insurance company will be able to recover your excess and there is no clause in your policy condition that states that they will recover and reimburse you your excess.
